Trade Marks, Registered Designs and Consumer Protection

Jennifer began her working life as a research scientist at Murdoch University, Western Australia and subsequently entered the patent attorney profession in 1987 practising in the registration of patents, designs and trade marks in Australia and overseas. After completing her Bachelor of Laws in 1994, Jennifer gained extensive commercial and litigious intellectual property experience working as a lawyer in some of Australia’s largest law firms before establishing the firms EKM legal in 2004 and EKM patent & trade marks in 2006 with David King.

Over the years, Jennifer has advised numerous Australian and overseas entities from a broad range of industries including engineering, chemical, food and beverage, publishing, dairy, pharmaceutical, telecommunications, cosmetics, education and agriculture. Jennifer has acted before the Federal Court of Australia in patent and trade mark infringement proceedings and in actions involving a breach of sections 52 or 53 of the Trade Practices Act. She has also acted before the Supreme Court of Victoria in relation to claims for misuse of confidential information, copyright infringement and breaches of patent and trade mark licenses.

Jennifer specialises in trade mark law and practice, and provides her clients with advice in all facets of trade marks including strategic advice, trade mark registration, due diligence work, infringements and disputes. She enjoys trade marks as it is the most visual and arguably, the most commercially important and powerful of all intellectual property rights as we all live in a world surrounded by brands and their messages Jennifer is currently a Councillor of the Institute of Patent and Trade Mark Attorneys of Australia and is also on the Trade Mark Committee (Australian Branch) of the Asian Patent Attorneys Association. Jennifer is also a Committee member of the International Trade Marks Association. As a result of her involvement in various intellectual property organisations, Jennifer travels extensively each year to attend international conferences to keep updated on changes in international law and also to meet and build networks with like- minded specialist intellectual property firms from other countries.

Her out of work interests include wine appreciation, world affairs, golf, running, fitness, cooking, travel and entertaining, learning French and taking care of her cats Tonka, Brunello and Montalcino.
